Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the DaChurchMan platform and all related services provided by SageIT Services ("we", "our", or "us"), including the web dashboard, mobile applications, desktop applications (Worship Console and Worship Studio), DaChurchMan Social, DaChurchMan Pay, and our website.

By creating an account, downloading our apps, or using any of our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

2. Eligibility

  • You must be at least 13 years old to create an account and use DaChurchMan services.
  • If you are between 13 and 18, you must have parental or guardian consent to use our services.
  • By using our services, you represent that you meet these eligibility requirements.

3. Account Registration

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the confidentiality of your account credentials, including your OTP verification codes.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Use of Services

4.1 Permitted Use

DaChurchMan is designed for church administration and community engagement. You may use our services to:

  • Manage church membership, attendance, and records.
  • Process and track financial transactions (tithes, offerings, donations).
  • Communicate with church members and administrators.
  • Access sermons, events, announcements, and church media.
  • Use worship presentation and broadcast tools (Console and Studio).
  • Participate in the DaChurchMan Social community.

4.2 Prohibited Use

You must not:

  • Use our services for any unlawful, fraudulent, or malicious purpose.
  • Attempt to gain unauthorised access to other users' accounts or church data.
  • Reverse engineer, decompile, or disassemble any part of our software.
  • Use our platform to distribute spam, malware, or harmful content.
  • Scrape, harvest, or collect data from our platform without authorisation.
  • Impersonate any person or entity, or misrepresent your affiliation with a church.
  • Interfere with or disrupt the integrity or performance of our services.
  • Use our communication tools (chat, SMS, push notifications) to send unsolicited commercial messages.

5. Church Administrator Responsibilities

If you are a church administrator using DaChurchMan:

  • You are responsible for the accuracy and lawfulness of the data you enter into the system.
  • You must obtain appropriate consent from your church members before storing their personal information on the platform.
  • You are responsible for managing user roles and permissions within your church account.
  • You must not use bulk communication features (SMS, push notifications) to send messages unrelated to legitimate church activities.
  • You are responsible for ensuring that financial records entered into the system are accurate and comply with applicable laws.

6. Per-Church Mobile Applications

DaChurchMan provides custom-branded mobile applications for individual churches. These apps:

  • Are published under the church's name and branding on the Apple App Store and Google Play Store.
  • Remain the intellectual property of SageIT Services.
  • Are subject to the app store policies of Apple and Google respectively.
  • May be removed from app stores if the church's subscription is terminated or these Terms are violated.

7. Payments and Subscriptions

  • Certain features of DaChurchMan require a paid subscription by the church.
  • Payment processing is handled by Paystack. By making a payment, you also agree to Paystack's terms of service.
  • Subscription fees are billed as agreed between the church and SageIT Services.
  • We reserve the right to change subscription pricing with reasonable notice.
  • Refunds are handled on a case-by-case basis. Contact us for refund requests.

8. Intellectual Property

  • The DaChurchMan platform, including all software, designs, logos, and content, is the intellectual property of SageIT Services.
  • You retain ownership of the data you input into the platform (membership records, financial data, media content, etc.).
  • We grant you a limited, non-exclusive, non-transferable licence to use our services for their intended purpose.
  • The Worship Console hymn library, canticles, and Bible translations are licenced for use within the application only and may not be extracted or redistributed.

9. Content and Media

  • You are responsible for any content you upload, post, or share through our platform (sermons, images, videos, messages).
  • You must have the necessary rights or permissions to share any content you upload.
  • We reserve the right to remove content that violates these Terms or is reported as inappropriate.
  • By uploading content, you grant us a limited licence to store, display, and transmit that content as necessary to provide our services.

10. Service Availability

  • We strive to maintain high availability of our services but do not guarantee uninterrupted access.
  • We may perform scheduled maintenance that temporarily affects service availability.
  • We are not liable for any loss or damage resulting from service interruptions, whether planned or unplanned.
  • We reserve the right to modify, suspend, or discontinue any feature of our services with reasonable notice.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • DaChurchMan and SageIT Services are provided "as is" without warranties of any kind, whether express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
  • Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
  • We are not responsible for the actions of church administrators or how they manage data within their church accounts.

12. Termination

  • You may stop using our services and request account deletion at any time by contacting us.
  • We may suspend or terminate your access if you violate these Terms.
  • Upon termination, your right to use our services ceases immediately.
  • Your data will be retained for 90 days after account deletion, after which it will be permanently removed (except where retention is required by law).

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising from these Terms shall be resolved in the courts of Ghana.

14. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will notify you through the app or via email. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
